Ohio Third OVI Low Tier Test
The chart below outlines the penalties for a third offense OVI when:
- You do not have a prior OVI conviction within 10 years of the date of your current charge.
- You took a chemical test and you tested above the .08 legal limit for alcohol but the test was below the .17 high tier limit for alcohol
-or- - You tested above the legal limit for marijuana or other specified drugs.
This offense is known as the OVI Low Tier offense.
You may also be charged with other offenses if:
- You took chemical test
- You refused a Chemical test and have a prior OVI conviction within 20 years of the date of this offense.
